Recreational Marijuana in Oregon: What Visitors Need to Know

The people of Oregon voted Measure 91, which allows the personal use and possession of recreational marijuana, into law in November of 2014.

This law also authorizes the Oregon Liquor Control Commission (OLCC) to regulate recreational marijuana, including implementing licensing and taxation policies. Oregon’s law differs from that implemented in the neighboring state of Washington in one major way – Oregon residents will be allowed to have up to four marijuana plants in their private homes.

Note: Oregon’s recreational pot law does not preempt federal law, which can still prosecute the production, distribution, sale, possession, and use of marijuana. How Much Pot Can I Possess in Oregon?

It is the provision regarding the amount of pot a person can carry in public that is most relevant to Oregon visitors – that limit is one ounce. Those who live in Oregon can possess up to eight ounces or four plants per residence but are also limited to carrying one ounce in public.

What Is Illegal in Oregon Regarding Pot Possession and Use?

Even after Oregon’s new recreational pot law took effect on July 1, 2015, these things will remain illegal and subject to fine or imprisonment.

  • Possession of amounts above the limit
  • Possession by a person who is under the age of 21 years
  • Any public use
  • Transportation of marijuana products to another state, even to Washington State
  • Driving under the influence of marijuana
  • Production or sale without a state license

Oregon visitors should be aware that pot use and possession remains a criminal act on federal lands, which includes the national parks and national forests that are popular recreation spots and likely to be a part of your Oregon vacation.

The Oregon Medical Marijuana Program is a state registry program that is under the administration of the Oregon Health Authority Public Health Division.
